What type of water rights/claims are eligible for participation in the Delta Alternative Compliance Plan (DACP)?

Statement Numbers (“S0___” numbers) and Water Licenses (“A0___” numbers) are eligible for participation in the DACP.


Does the Place of Use of a Statement Number and Water License need to be located within the Legal Delta in order to be eligible for participation in the DACP?

Yes. The DACP only applies to Statement Numbers and Water Licenses that have a Place of Use located within the Legal Delta. Click here to view a map of the boundaries of the “Legal Delta” (as defined by Water Code section 12220). The “Legal Delta” includes both the “primary” and “secondary” zones depicted on that map.


Is there a cost to participate in the DACP?

Yes for some diverters and no for others. There will be no cost to participate in the DACP for diverters with Places of Use located within the Central Delta Water Agency (CDWA) or South Delta Water Agency (SDWA) that pay the annual assessments of those agencies (some state agencies do not pay those assessments and will have to pay the below Participation Fee). Because the CDWA and SDWA have shouldered the costs to create the new software and website for the DACP, and because they will continue to incur costs to implement the DACP and keep it operational, there will be an annual Participation Fee for diverters with Places of Use located outside the CDWA and SDWA.

For Statement Numbers, the Participation Fee will be a charge per acre based on the acreage of the Place of Use of the Statement Number(s) enrolled in the DACP.

The annual Participation Fee for Statement Numbers is expected to be the highest for the first year because of the substantial startup costs. The fee for the first year (Water Year 2022) is $1.20 per acre. The fee for the second year (Water Year 2023) is $0.45 per acre.

For Water Licenses, there is no Participation Fee for any DACP participant for Water License reports for Water Year 2023 (regardless of whether the Place of Use of the Water License is located within or outside the CDWA and SDWA).


Where can I obtain a copy of the formal “Agreement to Participate in the DACP”?

You will be provided a link to review and print a copy of that agreement when you first register with the DACP (i.e., create an account with the DACP). You will also be required to accept the terms and conditions in that agreement at that time. The DACP cannot find the field(s) (Place of Use) associated with my Statement Number? When I enter my Statement Number (Water Right ID) and its password, I receive the following error message: “Validation Passed but your field does not exist on our system. Please contact Brett Baker at brettgbaker@gmail.com.”

That error message means a digitized map of the Place of Use of your Statement Number has not yet been uploaded to the DACP. You cannot file a Statement Number report under the DACP without such a digitized map. As indicated, if you receive that error message please contact Brett Baker at brettgbaker@gmail.com or (209) 465-5883 so he can assist you with creating and/or uploading that digitized map to the DACP. Note that it may take several weeks to create and upload that map to the DACP.
